Developer Fees

In 1986, the California Legislature authorized school districts to levy impact or developer fees on residential and commercial/industrial development for the purpose of funding the construction or reconstruction of school facilities.  The basis of the school facilities legislation is the relationship between new development, and the impact on school districts to provide adequate school facilities for the student population new development generates.  The authority for the District's assessment of developer fees is set forth in Education Code Section 17620.
 
Government Code Section 65852.2 effective January 1, 2020, amends how impact or development fees can be levied on Accessory Dwelling Units (ADUs) under 750 square feet.  However, this law expressly applies only to cities, counties, water districts, and special districts. School districts do not fall into any of these categories.

NOTICE OF PUBLIC HEARING AND OF PROPOSAL FOR INCREASING SCHOOL FACILITIES FEES AS AUTHORIZED BY GOVERNMENT CODE SECTION 65995

 

PLEASE TAKE NOTICE that immediately following a public hearing on the matter, a resolution will be considered by the Governing Board of the San Lorenzo Unified School District at its regular meeting on May 5, 2026 at 7:00 PM located at San Lorenzo Unified School District Office, 15510 Usher Street, San Lorenzo CA 94580, which if adopted by the Board will increase development fees established by the District against residential construction and reconstruction by the maximum of $5.38 per square foot; while commercial or industrial construction will also be increased to the maximum of $0.87 per square foot, except rental self-storage facilities which will be charged $0.11 per square foot of new construction. The proposed fees are authorized by Government Code Section 65995. Data pertaining to the cost of school facilities is available for inspection during regular business hours at the District Office. The increased fee, if approved by the Governing Board, will become effective on July 4, 2026, which is 60 days after the proposed adoption of the resolution levying such fee by the Governing Board.
